自由主義的権利のゲーム理論的分析
Recent Development in Game Theoretic Analysis of Libertarian Rights
要旨Abstract
自由主義的権利体系と社会厚生をめぐる原理的問題に関するパレート・リベラル・パラドックス問題を始点に展開された、規範的権利理論における90年代の研究の進展を概観する。第一に、アマルティア・センの提起する社会決定関数アプローチにかわる、ゲーム形式を用いた自由主義的な個人的権利の定式化が提唱された事、第二に、権利体系の内部整合性の条件として、ナッシュ可解的ゲーム形式の存在の議論がなされてきた事、第三に、ゲーム形式に置けるパレート・リベラル・パラドックス問題が議論されてきたこと、第四に、ナッシュ可解的ゲーム形式であって、もっともらしい自由主義的価値基準を満たし、かつ、パレート効率的な状態をナッシュ均衡として達成できるものが存在すること。その意味で、社会決定関数の場合と対照的に、ゲーム形式による権利体系の下では、自由主義的価値とパレート原理が一般的に両立し得ると主張できること、以上である。
The paper surveys recent normative discussions of individual libertarian rights and social welfare. It starts with the game form formulation of individual rights, and reviews the analysis for internal consistency of individual rights system, and also the arguments leading to the Pareto-Liberal Paradox in the game form formulation of individual rights. It finally points out that the Pareto-Liberal Paradox can be essentially resolved in the game form formulation.
