審査官引用は重要か―特許価値判別指標としての被引用回数の有用性―

要旨Abstract

　本稿の目的は，審査官引用が特許価値の判別指標として有用かどうかを確かめることにある．米国では，特許が出願人によって引用される回数(被引用回数)はイノベーションの価値を測る尺度として重視され，多くの経済学的な実証分析に用いられている．日本でも2005年に本格的な特許データベースが開発され，今後被引用回数を利用した経済分析が数多く行われるであろう．ところが，日本のデータベースが収集した引用情報は出願人引用ではなく審査官引用であった．米国の出願人引用の有用性はすでに多くの研究によって確かめられているのに対し，日本における審査官引用の有用性を検証した研究はまだ行われていない．そこで本稿では，特許の登録更新確率を被引用回数が有意に説明するか否かをプロビットモデルにより推計した．推計の結果，審査官引用は安定的に登録の更新確率を説明し，日本における審査官引用も特許価値判別指標として有用性を持つ可能性の高いことが確認された．

　This paper investigates the importance of examiner citation of patent as an indicator of patent value in Japan. I estimate the probability of patent renewals by using the Ordered Probit method. Estimation results suggest that examiner citations are significantly related to the probability of patent renewals. This means that examiner citations are important as a measure of innovation quality.
